Users who sign-up and use services offered by this website are bound by and accept the following terms, conditions and acceptable usage policy. DEFINITIONS: The Following definitions apply to the terms used in this agreement.

• The Christian Market Place (TCMP.biz) - Entities associated with this website, it's mirror sites including but not limited to the parent company and its associates and/or founders.
• Member - An individual or an entity that signs-up for any of the products/services provided by The Christian Market Place.org (TCMP.biz).
• 'Oath of Integrity' - A binding oath that our members agree to adhere to by their honor
• 'Articles of Faith' - The common thread between all of The Christian Market Place.org (TCMP.biz) members.
• 'Online store' - Web presence created by using The Christian Market Place.org's (TCMP.biz) proprietary software solution on The Christian Market Place.org and (TCMP.biz) website.
• 'Advertiser' or 'sponsor' - Third party paying The Christian Market Place for advertising their products and or services on The Christian Market Place.org (TCMP.biz) website.
• 'Church e-Card' - To qualifiy for this plan, you must be a valid Church, with a physical location able to be found by zip code reference. E-Church's do not qualifiy for this plan.
• 'Digital goods' - Products or services that do not require to be shipped physically from one location to the other. These include products that can be delivered online (via email or via instant access). These types of products include but are not limited to e-books, software, memberships, etc.
• 'Content'- downloadable files, text files, and all data, which is interpreted by a client web browser for display with or without plug-ins.
• 'Commissions' - A percentage based fee as remuneration for services rendered or products sold in conjunction with The Christian Market Place (TCMP.biz) technology.
  

TERMS OF SERVICE (TOS's): 

The Christian Market Place.org (TCMP.biz) may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification to its members. Members should check our terms of service regularly for additions and modifications. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Christian Market place (TCMP.biz) program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

REQUIREMENTS & RESPONSIBILITIES OF MEMBERS: 

You must be 18 years of age or older. Our program is open to both International members and US and is void where prohibited by local governing laws. You must read and agree to our "Oath of Integrity" and "Articles of Faith" before signing up. WARRANTY OF OWNERSHIP AND NON-INFRINGEMENT :
YOU REPRESENT AND WARRANT THAT YOU ARE THE OWNER OF THE CONTENT WHICH YOU SUBMIT AND THAT THE CONTENT DOES NOT INFRINGE UPON THE PROPERTY RIGHTS, INTELLECTUAL PROPERTY RIGHTS (COPYRIGHTS AND TRADEMARKS) OR OTHER RIGHTS OF OTHERS. YOU ALSO REPRESENT THAT THERE ARE NO OUTSTANDING DISPUTES IN CONNECTION WITH THE PROPERTY RIGHTS, INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS IN THE CONTENT OR ANY PARTS OF THE CONTENT.

ACCEPTABLE USE: 

Members can use their online stores only to list legitimate items. Products or any other items that may be inappropriate for younger audience are ABSOLUTELY NOT ALLOWED. Members cannot use their stores to list hate related items, pirated digital content or any product that violates or defames others. Music Accounts must either be the solo artist being represented, be a member of the music group, or must be officially selected to represent the Artist/band here at tcmp.biz. Misrepresented accounts will result in permanent banning from this site. Members are not allowed to use their online store for the sole purpose of promoting any affiliate programs including our affiliate program. The Christian Marketplace (TCMP.biz) reserves all rights to decide which use of online stores and advertising sites are acceptable.

SELLING DIGITAL GOODS: 

Selling digital goods: The Christian Marketplace (TCMP.biz) has implemented PayPal's IPN (Instant Payment Notification) system. This is an attempt of providing the ability to the sellers to sell digital goods online using PayPal. The Christian Marketplace (TCMP.biz) does not take any responsibility for any type of outcome of the use of this technology. The Christian Marketplace (TCMP.biz) cannot guarantee the security of the seller’s digital products.

COMMISSION PROGRAMS: 

Commissions paid are based on a percentage basis and are outlined in the package located at http://tcmp.biz/htm/store.php  Only those with items to sell are eligible for this program. TCMP.biz reserves the right to choose which submissions to accept and which to decline. These rates and terms change from time to time and it is your responsibility to check this page for updates.  Last Revised August 14, 2007.  By selecting the “I Agree” button, you are agreeing to the terms, which serve as a binding agreement (hereinafter “the Agreement”) between you and The Christian Market Place (“TCMP.biz”).

REGISTRATION, EMAIL AND PASSWORD:

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You will use your email address/password combination to access your account; it is your responsibility to keep this information confidential. You are solely responsible for any and all use of your user account including authorization by you to any third party individual that may use your account. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by The Christian Market Place (TCMP.biz) be detected it may result in member's account termination and possible legal action.

PAYMENTS: 

The service provided by The Christian Marketplace (TCMP.biz) is charged at various levels as described on the sign-up page of this website. Our billing system will charge according to the plan chosen at sign-up. If mentioned on the site, the member is given a free evaluation period and if user does not cancel the subscription during the free evaluation period, we will charge the member's Paypal or other credit card account without notice. Billing set-up fees and extra design services are non-refundable. User may cancel the subscription on his/her own at least 10 days prior to the lease renewal term via email -To ensure proper credit please watch for a confirmation email within 48 hours. If you do not receive this email it should be assumed that the request was not received and therefore not processed. In this case, please resubmit your request. If any member wants to upgrade or degrade their service level/plan, e-mail this request to: billing@tcmp.biz. The Christian Market Place (TCMP.biz) does not offer pro-rated refunds based on early cancellations or plan upgrades.

EARLY CANCELATIONS: 

The Christian Market Place (TCMP.biz) does not offer pro-rated refunds based on the early cancellations. Please note that if you wish to cancel a hosting package prior to the end of the term, be it a monthly or quarterly, or annual business package, you will forfeit any money paid for the our hosting services. Your contract begins upon approval of your store (via email confirmation) whether or not you begin setup.

INSUFFICIENT FUNDS: All accounts are due when billed. Should the funds be unavailable you will be given a 5-day grace period to bring your account current. If your payment is received after the 5-day grace period your account will be temporarily suspended and there will be a $25.00 re-activation fee. If the account remains delinquent for a period of 30 days the account will be terminated and all inventory deleted. Please note that we do not accept partial payments so please ensure that the funds are available each billing cycle to avoid any problems.

RE-ACTIVITATING FROZEN ACCOUNTS: 

There is a $25. Fee to re-activate frozen accounts. The Christian Marketplace (TCMP.biz) reserves all rights to reactive a frozen/inactive account and may choose to deny re-activation to an already existing user based on many factors such as spamming, inappropriate use, violation of acceptable usage policy, etc.

RELATIONSHIP TO PARTIES: 

You and The Christian Marketplace (TCMP.biz) are independent contractors, and nothing in this agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and The Christian Market Place. (TCMP.biz.). You understand that you do not have authority to make or accept any offers or make any representations on behalf of The Christian Marketplace.org (TCMP.biz). You may not make any statement, whether on your site or otherwise, that would contradict anything in this section.

LIMITATION OF LIABILITY:

The Christian Marketplace (TCMP.biz) will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or The Christian Marketplace (TCMP.biz) program, even if The Christian Marketplace (TCMP.biz) has been advised of the possibility of such damages. Furthermore, The Christian Marketplace (TCMP.biz) aggregate liability arising under this Agreement will not exceed the amount of the total fees paid under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

NO WARRANTIES BY THE CHRISTIAN MARKET PLACE.ORG (TCMP.biz)

THE SERVICE AND SOFTWARE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOU EXPRESSLY AGREE THAT THE USE OF THE SERVICE IS AT YOUR SOLE RISK. TCMP.BIZ DOES NOT WARRANT THAT THE SERVICES WILL BE UN-INTERRUPTED OR ERROR FREE, NOR DOES TCMP.BIZ MAKE ANY WARRANTY AS TO ANY RESULTS THAT MAY BE OBTAINED BY USE OF THE SERVICES. NO WARRANTY IS MADE BY TCMP.BIZ REGARDING ANY INFORMATION, SERVICES OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THIS AGREEMENT, AND TCMP.BIZ HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: (1) ANY WARRANTIES AS TO THE AVAILABILITY, QUALITY, QUANTITY, OR CONTENT OF SERVICES OR GOODS PROVIDED TO YOU HEREUNDER, INCLUDING BUT NOT LIMITED TO YOUR SERVICES AND YOUR WEB SITE; AND (2) ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TCMP.BIZ DOES NOT GUARANTEE THAT ANY CONTENT, INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE THROUGH THE TCMP.BIZ SERVICES WILL BE FREE OF VIRUSES, "WORMS", "TROJAN HORSES", OR OTHER HARMFUL COMPONENTS. YOU AGREE AND ACKNOWLEDGE THAT NO REPRESENTATIONS OF ANY KIND HAVE BEEN MADE TO YOU REGARDING THE POTENTIAL VOLUME OF PATRONAGE OF YOUR WEB SITE OR ANY OTHER PERSON'S OR ENTITY'S WEB SITE OR WEB PAGE.

INTELLECTUAL PROPERTY: 

Occasionally and from time to time, The Christian Market Place (TCMP.biz) will offer free Design Service, which may include but is not limited to Logo creation, button and banner creation, slogans, and the like. It should be noted that these types of services are not part of the general fees covered and do require a separate contract for such. While these services may be offered as a courtesy, as such, all items remain the property of The Christian Market Place (TCMP.biz) and are not to be used offsite, in auctions, on other websites, in print literature, or anywhere without the express written consent from The Christian Market Place (TCMP.biz). No images, slogans, button or banners are to be used in any way upon termination of a service agreement. Likewise the use of The Christian Market Place copywrited banners, buttons, slogans, and the like may be used as a display of your affiliation with our company, as long as written consent is requested and received.
